ACCEPTANCE OF TERMS

customflashdrive’s Terms and Conditions (the “Site”) by and between customflashdrive with its principal place of business at Hungary, 9012, Györ, Hegyalja 44., represented by Kövér Emese ev. (“Site”), and the customflashdrive user, is effective as of the first usage indicates your acceptance of these Terms and Conditions.

MODIFICATIONS OF TERMS AND CONDITIONS

Amendments to this agreement can be made and effected by us from time to time without specific notice. Agreement posted on the Site reflects the latest agreement and you should carefully review the same before you use this Site.

— USE OF THE SITE

The Site allows you to design USB and key ring models. After purchase you can download such models, or you can order the customized usb and or key ring. Each of the customized product is made-to-order.

— USER GENERATED CONTENT

You are responsible for ensuring that any User Generated Content that you provide does not, and will not infringe or violate anyone else’s rights, including copyright, trademark, patent, trade secret, privacy, publicity or other personal or proprietary rights. You promise not to provide User Generated Content unless you are the owner or have permission from the owner to post such content. customflashdrive reserves the rights to use any items customized by our customers for promotional materials on our online store or in any other environment.

HARDWARE

Your USB Drive, Custom-made Flash Drive is 3D Printed and assembled in Europe. Memory sticks are provided by a third party distributor. When referring to capacity, e.g. one gigabtye (1 GB) may not be available for data storage, as some of these capacity is used for formatting and other functions.

SHIPPING POLICY

Delivery Time
Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered. The product is manufactured and sent to carrier within 2-5 business days.

Shipping fee
To check worldwide shipping fees put the product in your cart. You will see how much is the shipping cost of the item. These are postal and carrier fees, but do not include taxes or custom fees in case of shipping outside of EUROPE. If your delivery address is outside of EUROPE we suggest contacting your country’s postal service for more information on taxes. Different shipping rates may apply during sales, promotional offers or for different/multiple products.

Damaged Items in Transport

RETURN, EXCHANGE AND REFUND POLICY

You can return unopened items in the original packaging within 14 days after your order has been received. If 14 days or more have passed since your purchase, we cannot offer you a refund or an exchange. Upon receipt of the returned item, we will refund your purchase price and a credit will automatically be applied to your original method of payment unless you do not want an exchange what you should indicate in writing an email to info@customflashdrive. In case of exchange we do not refund. Shipping cost of your return is not refundable.

Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

PRIVACY POLICY

We store order information in our database. That it necessary to process your order and deliver the chosen products.

BILLING INFORMATION

To complete a purchase on our Site, you must provide your name, current address, a valid email address, telephone number and any other information needed in order to complete the process. Any information provided by you or gathered by the Site or third parties during any visit to the Site shall be subject to the terms of our Privacy Policy.

PAYMENT

For checkout we use Services. Users, who don’t have PayPal account may checkout with their credit card registering at PayPal as first-time users or can checkout with PayMill.

WARRANTY DISCLAIMER AND EXCLUSIONS / LIMITATIONS OF LIABILITY

We make no express or implied warranties to the Designer Program running on the Site or any 3D-printed products sold including packaging. In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. We may change, restrict access to, suspend or discontinued the Site or any part of it at anytime. The information, content and services on the Site are provided on an as is basis. When you use the Site and or participate therein, you understand and agree that you participate at your own risk. While unlikely, customflashdrive is not liable for any damage, data loss, injury or any other liability that may arise while using any of our products and/or services.

INTELLECTUAL PROPERTY RIGHTS

You hereby acknowledge that all rights, titles and interests, including but not limited to rights covered by the Intellectual Property Rights, in and to the site, and that You will not acquire any right, title, or interest in or to the Site except as expressly set forth in this Terms and Conditions. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the Program or proprietary information related thereto. All content is a legal copyright of CustomFlashDrive.

CONFIDENTIALITY

You agree not to disclose information you obtain from us and or from our clients, advertisers, suppliers and forum members. All information submitted to by an end-user customer pursuant to a Designer Program is proprietary information of CustomFlashDrive. Such customer information is confidential and may not be disclosed. customflashdrive agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.

NON-ASSIGNMENT OF RIGHTS

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this Agreement, without liability to us. However, we may assign this Terms and Conditions to any person at any time without notice.

SEVERABILITY OF TERMS

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

ENTIRE AGREEMENT

This Terms and Conditions shall be governed by and construed in accordance with the substantive laws of Hungary in Europe, without any reference to conflict-of-laws principles. The Agreement describes and encompasses the entire agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Terms and Conditions.
